What paperwork you need to sell a car in California
Selling a car in California takes a few DMV forms. Here is a plain-English checklist — and what changes when you sell to a licensed dealer like us. This is general information, not legal advice; the California DMV has the final word.
The basic checklist
- California Certificate of Title (pink slip). Every owner listed must sign. If the names are joined by "AND", all of them sign; with "OR", one is usually enough.
- Lost title? The DMV form REG 227 (Application for Duplicate or Paperless Title) replaces it. When you sell to us, we help you fill it out.
- REG 262 (Vehicle/Vessel Transfer and Reassignment). Used as a bill of sale and for the odometer disclosure when needed.
- Notice of Transfer and Release of Liability (REG 138). The seller should file it with the DMV within 5 days of the sale (California Vehicle Code §5900) — it can be done online. It protects you from tickets and tolls after the sale.
Do I need a smog certificate?
When you sell to a private buyer in California, the seller is generally expected to provide a valid smog certificate. When you sell to a licensed dealer, a smog certificate is not required from you (California Vehicle Code §24007(b)(1)). That is why we can buy cars that failed smog as-is.
Special situations
- You still owe money: the lender holds the title. We pay the lender directly and you get any difference.
- The owner passed away: the DMV has specific forms for heirs (for example REG 5, Affidavit for Transfer Without Probate, when there is no probate). Check with the DMV or an attorney for estates; we walk you through the car part.
- The car isn't in your name: only the owner(s) on the title can sell it, or it has to be transferred to you first.

Questions sellers ask
How many days do I have to file the Release of Liability?
California Vehicle Code §5900 gives the seller 5 days to notify the DMV. You can do it online on the DMV website.
Do I need a bill of sale?
REG 262 serves as a bill of sale. When you sell to us, we prepare it with you.
Can I sell without the title?
If you are the registered owner, yes — with a duplicate title application (REG 227) signed by the owners. We help with it.
Is this legal advice?
No. It is general information based on California DMV forms as of 2026. For your exact case, check with the DMV or an attorney.
